Is UIGEA Only An Act Of Protectionism?

Whether or not the UIGEA is strictly an act of protectionism depends on your definition of protectionism. It seems as if the term and usage of protectionism has evolved over the years. Many regard it as an ugly word these days. In the days that George Washington was president, protectionism was in many ways a good thing. At that time, they wanted to build the United States, keep as much business in the States as possible and that was a good thing back then. Today protectionism may not be as good given the current state of the global economy. Any country that creates more protectionism through law will not be as competitive in today's marketplace.

What Is Protectionism?

Today, the majority of all online gambling sites are based in Antigua and the Bahamas. There are currently no online gambling sites being run out of the United States. Technically, if the UIGEA is an act of protectionism, then American business owners should be able to start a site now, but they are not allowed to do so, so really it’s not an act of protectionism. It’s simply just taking away the freedoms of the American citizen. It would be great to have an online gambling site based in the States. Why have all those billions of dollars go to a couple small islands? Shouldn't the US reap the rewards of the industry and take in the millions of tax dollars?

Given that some form of legal gambling is available in nearly every state, why even bother with criminalizing one aspect of gambling. So many issues that are more important need to be resolved, and it makes the UIGEA looks like the biggest waste of time. Let American citizens decide for themselves if they want to play blackjack or not. It’s fine to ban international sites but that's only if an American site could replace it. But as it stands now, the UIGEA is not really an act of protectionism. It’s the removal of a citizen’s right to decide for themselves. It is important to protect the interests of America, but the UIGEA isn’t really protecting the interests of the citizens – certainly not the players.
